General Terms and Conditions when using this site

This website is owned and operated by Wix.com on behalf of Si Bridal & Co. These General Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors a preview of the collections of bridal gowns available in the boutique, we provide an online booking service for brides. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

1. Commercial Terms
In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

2. Privacy
You understand that it may be necessary for us to collect personal information about you. In doing so, Si Bridal promises to respect and safeguard the privacy of your personal information as set forth in Si Bridal’s Privacy Policy, available at https://www.sibridal.com, as modified by us from time to time. In most cases, we will rely on your consent to process your personal information. You may indicate your consent in a number of ways, including, as permitted by law, ticking a box (or equivalent action) to indicate your consent when (i) providing us with your personal information through our Services or a form (including enrolling in Promotions); or (ii) registering or creating an account with us. In some cases, we will directly ask for your consent to process your personal information. You understand and agree that when you volunteer personal information about yourself you are providing Si Bridal with affirmative consent to collect the personal information about you.
You may at any time withdraw your consent with future effect and without affecting the lawfulness of processing of your Personal Data based on the consent you provided before you withdrew it, and exercise other controls regarding website and online data collection, interest-based advertising, your communication settings, and app preferences. 3.Purchasing and Refund Policy (online purchases)
When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.
The fee for the services and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged on a monthly basis to your payment method.
We do not accept refunds on any sample gown (bridal or bridesmaid) or bridal accessories purchased online through the website, all sales are final. If you have any queries about an item before purchasing please email enquiries@sibridal.com or call (0191) 242 3063.
If products are not available by the time your order processes, we will notify you of this via e-mail. You can always verify availability with our customer service representatives by sending an e-mail to us at enquiries@sibridal.com.

4. Retention of right to change offering
We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

5. Disclaimer and Limitation of Liability
Si Bridal & Co. tries to keep the Site up, error-free, and safe, but Si Bridal does not guarantee that the Site or the Content will be safe or secure or that access to or use of the Site will be uninterrupted or free of errors or omissions or that defects will be corrected. Si Bridal does not warrant that the Site will operate error-free or that the Site and its servers are free of computer viruses or other harmful components. Si Bridal uses reasonable care and skill on providing the Site, but beyond that the Site and the Content are provided without any warranties of any kind. Si Bridal disclaims all other warranties, whether express or implied, including any warranty, condition or other terms of satisfactory quality, merchantability, fitness for particular purpose and non-infringement. Si Bridal makes no warranties about the accuracy, reliability, completeness, or timeliness of the Site or the Content.
6. Copyright and Intellectual Property
The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Si Bridal & Co. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

7. Right to suspend or cancel user account
We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.

8. Indemnification
You agree to indemnify and hold Si Bridal & Co. harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.
9. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall Si Bridal & Co., be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Si Bridal & Co. assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
10. Your Submissions
You may not post on or transmit through the Site any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, racially, ethnically, or otherwise objectionable content of any kind, including, but not limited to, any content that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise breach any applicable law. If we are notified that you have submitted or posted such content, then we may investigate the allegation and determine in our sole discretion whether to remove or request the removal of such content from the Site. The Site and services included on the Site, each of their respective components, all content provided by or through the Site, together with the user interface, the compilation and arrangement of the Site, and the text, photographs, audio and video, graphics, logos, illustrations, descriptions, data, and other material available on or through the Site are referred to collectively as the "Content". Si Bridal may change, delete, or update any Content at any time and without prior notice.

12. Right to change and modify Terms
We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

13. Promotional emails and content
You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time by emailing enquiries@sibridal.com.

14. Preference of law and dispute resolution
These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the United Kingdom, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Newcastle Upon Tyne. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

15. Miscellaneous
These Terms, and any disputes of any kind between you and Si Bridal or its Providers, shall be governed by, construed and resolved in accordance with the laws of the England. Sole and exclusive jurisdiction for any action or proceeding arising out of, or related to, the Terms, use of the Site, or any orders placed or products purchased through the Site, shall be in the courts of England. The European Online Dispute Resolution platform https://ec.europa.eu/consumers/odr/ provides information about alternative dispute resolution which may be of interest and we are required to inform you that you may use it if there is a dispute that cannot be resolved between you and us.
Your use of the Site will be deemed to be your consent to receive electronic communications from us, whether addressed to the e-mail address associated with your account or posted at the Site. You acknowledge and agree that any communication by e-mail or by posting on the Site satisfies any legal requirement that such communications be made in writing.
